The natural mother of the boy detained on the Arbat stated that the father exploited the child. How the situation around the boy detained on Arbat is developing. There will be a criminal case.

On the evening of May 26, in the center of Moscow on Vozdvizhenka Street, police detained a 10-year-old boy who was reading excerpts from Hamlet aloud. The rain has collected everything that is known about this story.

Journalist Lyusya Stein was the first to report the boy’s arrest. According to her, the incident took place on Vozdvizhenka Street: the police “grabbed a boy who looked to be about nine years old who was reading poetry, shoved him into a wheelbarrow and took him away in hysterics.” At the same time, law enforcement officers did not introduce themselves or explain on what basis they detained the boy, despite the protests of the child’s stepmother. As a result of attempts to prevent the boy from being apprehended, the woman’s clothes were torn and her tablet was broken.

As the boy’s father, Ilya Skavronski, told Mediazona, his son and wife were walking in the Arbat area. On Vozdvizhenka, the boy began reciting fragments from Hamlet to passers-by, and his stepmother was 20-25 meters away from him and reading a book.

“A police squad arrived and they were talking about something without her participation. Then they tied him up, there is a video recording of what happened. They started pushing us in - she came up and tried to prevent it,” Skavronski said.

The police explained the detention by saying that, in their opinion, the boy was begging. However, the child's father stated that this was not the case. According to him, the boy is engaged in theatrical activities, and “for him, these trips to the street are a fight against complexes.”

One of the eyewitnesses told Varlamov.ru that three police officers surrounded the boy and a thermal bag standing on the ground, “the female police officer seemed to be scolding him, and then they dragged him into the car, and some young man tried to stop them.”

At the same time, the eyewitness said that everything looked “like a rather everyday story for the neighborhood of Arbat, and decided that “maybe the child was begging or ran away from home.” In the capital's department of the Ministry of Internal Affairs later: the police decided that the boy was lost because he was on the street unaccompanied. According to the police, the boy approached passers-by and cars one by one and could not tell the police where his parents were.

As a result, the child was taken to the Arbat police station, where his father soon arrived. Later, the chairman of the Public Council under the Ministry of Internal Affairs, Anatoly Kucherena, came to the police station. The video from the department shows that Kucherena spoke with the boy, who said that he was in third grade. Around midnight, the boy and his parents were released by police.

Children's Rights Commissioner Anna Kuznetsova also became interested in the story of the boy's detention.

The Ministry of Internal Affairs stated that they began an investigation into the incident with the child. “During the inspection, all the circumstances of the incident will be carefully, objectively and comprehensively studied and the actions of the police officers will be assessed. The results of the inspection will be communicated to the public,” the press service of the Ministry of Internal Affairs for the city told the Moscow agency.

It also became known that the administrative protocol on failure to fulfill parental responsibilities drawn up for the boy’s father would be cancelled. In addition, the police are in front of the child's father.

What's happened

On the evening of May 26, on Vozdvizhenka Street, next to the Arbatskaya metro station, police officers detained a 10-year-old boy who was reading excerpts from Shakespeare’s play Hamlet. Video of the arrest published on their Facebook, witness to the incident Lyusya Stein and activist Irina Yatsenko ( record contains obscene language). The footage shows police dragging the child into the car, ignoring his resistance and cries for help. Three police officers took the child to the Arbat police station, where his parents later arrived.

According to official data from the Main Directorate of the Ministry of Internal Affairs for Moscow, the reason for the detention was the boy’s presence in a public place without being accompanied by his parents and begging. Where were the parents at the time of arrest?

According to the father, the child was not alone on the street. While his son was reading Hamlet, his wife, the child’s stepmother, stood a few meters away from him. “The wife was sitting, reading a book, and the child was reciting Hamlet. A police squad arrived and they were talking about something without her participation. Then they tied him up, there is a video recording of what happened. They started pushing us in - she came up and tried to prevent it,” he said. Skavronski noted that the police behaved rudely and swore.

Do police officers have the right to detain children?

The police have the right to detain and bring to the station persons under the age of majority. According to Article 14 of the Federal Law “On Police”, in the event of the detention of a minor, the officer is obliged to notify his parents or legal representatives about this.

A child can be detained for antisocial behavior - “actions of an individual that violate generally accepted standards of behavior and morality, the rights and legitimate interests of other persons,” which do not entail administrative or criminal liability.

Also, police officers can deliver to the department any child who is found unaccompanied by parents at night (11:00-7:00 in Moscow) in a public place - on the street, stadium, park, square, on a bus or in the subway.

In some cases, police officers have the right to use physical force against a minor - to suppress an offense, as well as when resisting arrest.

Drawing up protocols

Immediately after the boy was detained, his parents arrived at the police department. A statement from the Main Directorate of the Ministry of Internal Affairs for Moscow states that “at about 10 p.m. the boy was handed over to his father.” An administrative violation report was drawn up against Skavronski under the article for failure to fulfill the duties of raising minors. His wife received a report for disobedience to a police officer.

In the evening, the chairman of the public council under the Ministry of Internal Affairs and lawyer Anatoly Kucherena came to the police department. On videotape, published Irina Yatsenko, Kucherena looks through the case materials, speaks with the child’s parents and the police. The stepmother and child left the department closer to midnight, and an apology was made to the boy.

On May 30, on the air of the Komsomolskaya Pravda radio, Yuri Titov, Deputy Head of the Information and Public Relations Department of the Main Directorate of the Ministry of Internal Affairs of Russia for Moscow stated that the child’s natural mother wrote a statement to the police, accusing his stepmother Kristina Skavronski of involving the child in begging (Article 151 of the Criminal Code). According to the text of the statement, this is not the first time the boy asks for money on the street, despite the mother’s requests to the child’s father to prohibit him from doing this. In addition, the mother accused Skavronski's wife of taking almost all the money she earned on the street from the child, leaving him only small change.

Reaction

The day after the incident, the Investigative Committee began a pre-investigation check into the circumstances of the arrest. Commissioner for Children's Rights Anna Kuznetsova

Who on Novy Arbat became the most discussed news of the week, according to the police, admitted that he was collecting money. But given his age, there is no liability. Unlike his father and...Christina. They face real criminal charges. He is for involving minors in antisocial activities, and she is for insulting police officers while on duty.

The first messages were simply shocking - a child on the street was reading the classic Hamlet to passers-by. But suddenly the police appeared and dragged the boy into the car by the scruff of the neck. The adult aunt, who tried to protect the child, was responded to with rude words and actions. The video of the incident was viewed online by tens of thousands of users in a matter of hours. All right and wrong law enforcement agencies, who are legally allowed to check what happened, announced through their representatives that they were starting to look into it. So far, nothing is known about the results of their checks.

But the more time passed after the arrest, the more additional information appeared that changed the situation. Firstly, we looked at photographs of the moment of interaction between the child and the police. Bloggers were the first to suspect the boy reading poetry of begging - there was an open thermal bag next to him. Well, the seemingly random defender, who first introduced herself as a neighbor, then turned out to be the boy’s stepmother, sat a little away on a bench and watched.

State Duma Deputy Speaker Sergei Neverov said that the police detention of the minor boy was planned in advance, and the incident itself was a provocation.

Blogosphere

On social networks, the young reader was called the “Prince of Denmark.” There were also those who wrote that they had seen the child before - he walked between cars and asked the drivers for money. Other bloggers dug up information about the boy's family and told the whole world that the child's father and his partner were unemployed. The man, a former musician, came to the capital, rented an apartment and constantly borrowed money, and his common-law wife allegedly took the child to the Arbat to work more than once.

Police

The police voiced their point of view through the head of the press service of the capital's Main Directorate of the Ministry of Internal Affairs, Alexander Knyazev. He denied reports that the detention was organized in advance. According to Knyazev, the squad was conducting regular street patrols. And the woman who protected the child introduced herself as the boy’s neighbor. She asked me to give it to her. According to the law, the police have no right to do this. After which the citizen began to scream and insult the police officers while they were on duty. Police also confirmed that the child was approaching passers-by and drivers. Later, the boy himself told the police about this. The police consider the fact of begging established. At the height of the scandal, there were reports in the media that an apology was made to the child’s father, and the protocol against him was annulled.

The police responded to this with the following statement: “It is necessary to clarify that an apology was made to the child for the inconvenience caused. And in relation to the child’s father, a protocol on an administrative offense was drawn up under the article “Failure of parents or other legal representatives of minors to fulfill obligations for the maintenance and upbringing of minors,” and in against his wife - under the article “Disobedience to a lawful order of a police officer.”

The police promised that the results of the internal investigation would be announced publicly.

From the editor

Footage of a child being literally dragged to a car by big adults in uniform looks disgusting and is unlikely to be included in police instructions. If the child did not go into the car voluntarily, he could be carried away.

Memo for parents

1 Why can a minor be taken to the police station?

There are not many reasons. If he is on the street without the supervision of parents or legal representatives and is begging. The police are also required to pick up little strays. All options are described in detail in Federal law"On the basics of the system for preventing neglect and juvenile delinquency." The police instructions repeat the same thing. If a minor gets lost, the police must find the parents and give them the child for signature.

2 Maybe a friend of the parents can come pick up the child?

The police have no right to give the child to any stranger, not even grandparents. Only for moms and dads and official representatives with documents.

3 What is violated if you ask for money for poems and songs?

The Declaration of the Rights of the Child is being violated. We must respect and protect it little man from all forms of exploitation. .

4 What threatens parents who send them to beg?

Article 151 of the Criminal Code: “Involving a minor in committing antisocial actions.” The maximum term is five years.

5 Can the police call guardianship and give them the child?

They can if the parents are not found within three hours from the moment the minor is brought to the police station. Or they will find it, but will understand that giving them the child is dangerous for his life. But they won’t take you to the orphanage right away. They will send you to a children's hospital for examination, and if you are healthy, then within a week the guardianship will transfer the child to a boarding school.

Direct speech

Anatoly Kucherena, Chairman of the Public Council under the Ministry of Internal Affairs (from a radio interview):

At 11 o’clock in the evening I arrived at the police station in the Arbat district and saw a boy there. Father Ilya and stepmother Christina, she is Ilya’s wife, were there. Accordingly, I began to figure out what happened.

What I saw in the video is certainly very sad, because when police officers try to force a minor ten-year-old boy who was reading the poems of Hamlet into a car, this is bad. And at the same time, they say that he was alone and there were no adults, but the video clearly shows that there is Christina, even if she didn’t even know who she was. But since she is trying to get the child away from the police, then we must act honestly and wisely - invite this woman and the boy to the police department. And figure out who is who. When the boy screams, it is quite obvious that the boy knows this woman, even if she is not his mother, even if she is his stepmother, as it turned out in the end, do it all according to the law, because the actions of the police officers provoked this wave of indignation.

When we see a woman shouting “Give up the child,” and at the same time you are dragging the child into the car, how can these actions be assessed? I hope that this assessment will be objective and, under our control, appropriate conclusions will be drawn regarding those police officers who detained the child. Because the inappropriate behavior is obvious. Whether the child collected money or not, you will agree, it doesn’t matter. If the child even collected money or begged, and if there is an adult nearby who shouts “Don’t take the child,” invite him and the child to the duty station.
